How to prepare for settlement agreements in divorce cases

I

f you are contemplating divorce, you and your spouse are facing a variety of choices and challenges. You may be dealing with child custody and trying to settle property disputes. Your initial choices will determine how you approach and deal with the many remaining challenges. It is therefore of critical importance that you think very carefully and seriously as to how you wish to proceed. This will, without a doubt, be one of the most pivotal decisions you will make in the process of your marital dissolution. It may also be one of the most pivotal decisions of your life due to the potential long-term consequences. In addition to these decisions you are making, the manner in which you make them and how you conduct yourself will be crucial to your ability to move forward in a dignified and positive fashion.

The end of a marriage or other long-term commitment can be devastating. It doesn't matter why the marriage is ending. Just the imminent termination and the impending life changes will impose a significant stress upon all members of the impacted family – the husband, wife and their children. People are understandably angry, hurt, disillusioned and/or confused. The range of emotions is wide, but ultimately unique to each particular person. Whatever individual, unique set of emotional reactions to this huge stressor might be, the bottom line is that these emotions will be running high. Anxieties about the future are coupled with painful and/or uncomfortable reactions to the recent past. This is, for many people, a time of enhanced vulnerability and personal upheaval. This is one of the least advantageous times possible to become subject to the capricious and cold mechanisms of our traditional, adversarial legal system.

There is an intelligent and forward thinking alternative to traditional divorce litigation, one where you and your spouse are allowed to retain complete control over the process as well as the ultimate terms by which you bring your marriage to an end. Mediation is the choice that allows you to retain control over all the rest of the choices.
